{"id":374,"date":"2011-08-25T16:10:14","date_gmt":"2011-08-25T16:10:14","guid":{"rendered":"https:\/\/legalwebdesign.xyz\/eastbay\/?p=374"},"modified":"2021-01-27T16:11:10","modified_gmt":"2021-01-27T16:11:10","slug":"not-prosecuting-strauss-kahn","status":"publish","type":"post","link":"https:\/\/www.eastbaydefense.com\/es\/blog-post\/not-prosecuting-strauss-kahn\/","title":{"rendered":"Not Prosecuting Strauss-Kahn"},"content":{"rendered":"<p>This week, the DA in Manhattan dismissed all criminal charges against Dominique Strauss-Kahn, the head of the IMF and French politician who enjoyed international notoriety when he was arrested this May on an Air France jet for allegedly sexually assaulting a Manhattan hotel housekeeper.<\/p>\n<p>The decision to dismiss the charges comes as no surprise. Glaring credibility problems with the complaining witness \u2013 among them \u2013 she has brought phony rape charges in the past \u2013 took the wind out of the sales of the prosecution. But what does strike me is the DA\u2019s explanation. The Manhattan DA emphasized its office policy of not trying a case unless the district attorney him or herself is convinced of the defendant\u2019s guilt beyond a reasonable doubt. Not all district attorney\u2019s offices practice this policy. By law, they don\u2019t have to. They need only show probable cause in order to hold someone over for a felony.
