Federal District Court Judge Reggie Walton declared a mistrial and excused the jury because the government repeatedly presented evidence that was inadmissible. First, in opening statements, the government lawyer referred to steroid use among Roger Clemens\u2019 teammates, a fact that would simply subject Mr. Clemens to guilt by association. Second, the prosecution played a video \u2013 complete with running transcript at the bottom of the screen \u2013 that featured testimony that the judge had previously thrown out.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/www.eastbaydefense.com\/wp-content\/uploads\/2021\/01\/gavel3-150x150-1.jpg\" alt=\"\" width=\"150\" height=\"150\" class=\"alignright size-full wp-image-385\" srcset=\"https:\/\/www.eastbaydefense.com\/wp-content\/uploads\/2021\/01\/gavel3-150x150-1.jpg 150w, https:\/\/www.eastbaydefense.com\/wp-content\/uploads\/2021\/01\/gavel3-150x150-1.avif 150w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/>The judge declared that he cannot \u2018un-ring the bell,\u2019 and rejected a request from prosecutors to instruct the jury to ignore the inadmissible evidence, stating of Roger Clemens, \u201cHe\u2019s entitled to a fair trial and, in my view, he can\u2019t get it now.\u201d A hearing will be held September 2 to determine whether the government can re-try Mr. Clemens.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The doping trial of retired pro baseball pitcher Roger Clemens came to an abrupt and unceremonious end this week.
