Kidnapping

California defines kidnapping as moving a person from one place to another, by using force or instilling fear. (Penal Code 207) The District Attorney can charge a person with kidnapping even when the victim is not alleging that physical force was used. Kidnapping is charged as a felony. A charge of kidnapping is often accompanied by other criminal charges, such as armed robbery, extortion, and sex offenses. For this reason, kidnapping carries a heavy sentence.
